Terms of use
These terms are the agreement between you and Walk-Off Works ("we", "us") about the Veloburn iPhone app, the web app at app.veloburn.com, and the website at veloburn.com (together, "Veloburn"). By ticking the box when you create an account, or by using Veloburn after signing in, you agree to them. If you do not agree, do not create an account. You can still use the app on your own phone without one.
Our privacy policy explains what we do with your data. It is part of these terms.
1. What Veloburn is
Veloburn uses one iPhone on a tripod to follow pitches and batted balls and to show estimated speed, location, distance and other numbers. It can keep video clips, back up your sessions to your account, and let you share a player's numbers with family and with a coach.
2. Who can have an account
- You must be 18 or older to create an account. When you tick the box you are telling us you are 18 or older. We do not check your age.
- Children do not get accounts. A parent or legal guardian looks after a child's profile in their own account.
- Give us a real email address that you can read. Keep your sign-in codes to yourself. You are responsible for what happens under your account.
- One account is for one person. Do not share it.
3. Players, parents and coaches
If you add a player to your account, you are telling us that you are that player, or the player's parent or legal guardian, or that you have the parent's or guardian's permission to add them.
If you are a parent or guardian, you decide who sees your child's profile. You can invite family, join a team, choose whether a coach can see video clips, choose how far back a coach can see, and leave a team at any time. When you leave a team, that team's coaches lose access right away.
If you are a coach, you may see a player's numbers only after the player's parent or guardian joins your team (or the adult player joins it). You agree to:
- use what you see only to coach that player and run your team;
- not copy, post or share a player's numbers, video or notes outside Veloburn without the permission of the player or the player's parent or guardian;
- only make a "managed" profile for a player when you have the parent's or guardian's permission, and hand the profile over, or delete it, when the family asks;
- keep your account safe, and tell us if you think someone else has used it.
Coach notes. A coach can write a note that is shared with the player's family and the team's other coaches, or a private note that only that coach can read. A private note is deleted when the coach's access to the player ends. Families can write notes that coaches never see.
4. Your content
Your content is the video clips, numbers, names, notes and anything else you put into Veloburn. You own it. We do not.
You give us permission to store it, copy it, process it and show it to the people you choose to share it with, for the sole purpose of running Veloburn for you. This permission ends when you delete the content or your account, except for the short time deleted data can remain in backups (see the privacy policy).
You are responsible for your content. Only record people who know they are being recorded and who, if they are under 18, have a parent or guardian's permission. Do not upload anything unlawful, or anything that is not about baseball or softball training.
Help improve Veloburn. There is a separate switch that lets us use a player's clips and corrections to make Veloburn's ball tracking better. It is off until a parent, a guardian, or the adult player turns it on for that player. You can turn it off at any time, and we will stop using the data from then on. Today we do not train any model with it.
5. What you may not do
- Break the law, or use Veloburn to harass, threaten or embarrass anyone.
- Try to see data that is not yours or not shared with you, or try to break, overload or probe our systems.
- Copy or scrape Veloburn's data in bulk, or build a competing service from it.
- Pretend to be someone else, or make a profile of a player without the right to.
- Use the numbers as an official ruling, in a contract or for betting.
If you do, we may suspend or delete your account.
6. The numbers are estimates
The speeds, locations, distances, spin, pitch types and quality grades come from a phone camera and software. They are estimates. They can be wrong, and they are not official or certified measurements. Check anything important another way.
Veloburn is not medical, health or coaching advice. Throwing and hitting can cause injury. Warm up, follow a coach's or doctor's advice about workload, and stop if something hurts. Set up your tripod and phone so that nobody can trip on them or be hit by the ball. You use Veloburn and take part in training at your own risk.
7. The service can change
We are building Veloburn, and early versions can have mistakes. We may change it, add or remove features, or pause it. If we end the service, we will tell you by email first and give you time to export your data. Back up what matters to you: the web app can export all of your data as a CSV file.
8. Ending your account
You can delete a session, a player or your whole account at any time, in the app or on the web. Deleting your account cannot be undone. We may suspend or delete an account that breaks these terms or puts others at risk. If we do, we will say why unless the law says we cannot.
9. No promises, and limits on our responsibility
Veloburn is provided "as is" and "as available". To the fullest extent the law allows, we do not promise that it will be accurate, always on, or free from errors, and we are not responsible for indirect or consequential losses, lost data, lost profits, or injuries from training. If we are responsible to you for something, our total responsibility is limited to the larger of what you paid us in the 12 months before the problem, or US$100. Some places do not allow these limits, so they may not apply to you, and nothing here limits rights you have by law that cannot be limited.
10. If you got the app from the App Store
These terms are between you and us, not Apple. Apple has no duty to support Veloburn, and is not responsible for it or for claims about it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Apple's standard terms for apps also apply to your use of the app.
11. Changes to these terms
If we change these terms, we will change the date at the top. If the change matters, we will tell you in the app or by email before it starts, and ask you to agree again.
12. Law and disputes
These terms are governed by the laws of the State of California, USA, without regard to conflict of laws rules. Courts in California will decide disputes, unless the law where you live gives you the right to go to a court at home. Before starting a case, please write to us so we can try to fix it.
